These terms are a contract between you and HiddenSwap (“we”, “us”). By starting a swap, you accept them. If you do not accept them, do not use HiddenSwap.
1. The service
- HiddenSwap is a website for swapping one cryptocurrency for another.
- Swaps are carried out by a third-party exchange partner that provides the liquidity and processes the swap. We pass your order to the partner, show you its status and give you support.
- The partner’s rules for swaps also apply to your swap. These terms include those rules, so you do not need a separate agreement.
- We only swap crypto for crypto. We do not handle bank money, cards or other fiat currency.
- There are no accounts. Each swap has an order ID. Anyone who has the order ID can see that swap, so keep it private.
2. Who can use HiddenSwap
You can use HiddenSwap only if all of these are true:
- You are at least 18 and able to enter into a binding contract.
- You swap for yourself, not on behalf of someone else, and not as a business.
- The coins you send belong to you and come from a lawful source.
- You have not been blocked from the service before.
You may not use HiddenSwap:
- if you are located in, or are a citizen or resident of, a country or region under sanctions,
- where swapping cryptocurrency, or using this service, is not allowed,
- where our exchange partner does not offer its service.
It is your responsibility to check that you may use HiddenSwap where you are. Do not use any tool to hide your location in order to get around these rules. We and our partner may refuse, pause or stop a swap because of where it comes from.
In some cases, including where the law of your country requires it, you may be asked to verify your identity before a swap can continue. See section 8.
3. How a swap works
- You choose the coins, the amount and the rate type. We show an estimate that already includes fees.
- You give the address where you want to receive coins, with a memo or tag if that address needs one. You can also give a refund address.
- We create the order and show a deposit address, the exact amount and the network. Some networks also show a memo or tag that must be sent with the deposit.
- You send the deposit in one transaction. The partner confirms it on the network, swaps the coins and sends them to your address.
- The order page shows each step. A swap is complete when the order page says so and shows the payout transaction.
4. Rates
Floating rate. The estimate is not a promise. The final rate is set when the network has confirmed your deposit, so you may receive a little more or a little less. If the market moves sharply before the swap, you may be offered the choice to continue at the new rate or to get a refund.
Fixed rate. The rate is kept only if your deposit:
- arrives before the time shown on the order page runs out,
- is exactly the amount shown,
- is sent in one transaction to the deposit address of that order.
If any of these is not met, the swap may be processed at the floating rate, or refunded minus network fees. If the market moves by 3% or more before the swap, you may be asked to choose between the current rate and a refund.
5. Fees
The estimate already includes our service fee, the partner’s fee and the network fees for the swap. You do not pay anything else, except:
- network fees taken from a refund,
- the recovery fee in section 7, if a deposit has to be recovered because it was sent the wrong way.
6. Your responsibilities
You are responsible for:
- giving the correct receiving address, on the network shown, with the memo or tag your wallet or exchange needs,
- sending exactly the amount shown, on the network shown, in one transaction, to the deposit address of your order, with the memo or tag if one is shown,
- sending from a regular wallet (deposits sent from smart contracts are not processed automatically),
- using each deposit address for one order only and never reusing an old order’s address,
- keeping your order ID,
- following the law where you live, including tax rules. We do not report or withhold taxes for you.
Blockchain transactions cannot be reversed. We are not responsible for losses caused by wrong details you enter.
7. Deposits that do not match the order
- A different amount. An amount above the minimum is usually swapped at the floating rate. For fixed-rate orders, a smaller amount may be swapped in proportion, and a larger amount is held for review.
- Below the minimum. The swap may not be completed. A refund is not guaranteed, and it is not possible when the amount is lower than the network fee.
- A late deposit. Floating-rate orders wait about 24 hours for a deposit. Fixed-rate orders wait until the time shown. A late deposit may be swapped at the current rate, refunded, or need support.
- More than one deposit. Each order accepts one deposit. Several deposits, or one transaction paying several orders, need support, and the rate is not kept.
- Wrong coin, wrong network, or a missing or wrong memo. These deposits are not processed automatically. Recovery is sometimes possible but not guaranteed. When it is possible, a recovery fee of USD 50 plus network fees may be charged and paid separately before the coins are returned. Recovery can take up to 20 business days.
- Forked coins. Split coins from a network fork before you send them. Unsplit coins may not be recoverable.
8. Screening, verification and holds
- We do not ask for your name, email or ID to start a swap. Every swap is screened automatically against sanctions lists and blockchain risk data.
- A swap can be put on hold if screening flags it, if there is a report of fraud or stolen coins, or if the law requires a check. While a swap is on hold, the coins may be frozen for as long as the review needs.
- To release a swap on hold, you may be asked to verify your identity and where the coins came from, through a verification provider. The verification link usually stays open for 3 days.
- If you do not complete verification, the coins are normally refunded to the address they came from, minus network fees. If there are signs of illegal activity, the coins stay frozen and are released only as the authorities decide.
- Refusing verification, giving false documents or suspicious activity can lead to future swaps being refused and to the addresses involved being blocked.
- We and our partner may share information with authorities when the law requires it. See Risk and screening.
9. Refunds
- A completed swap is final.
- A deposit is refunded when a swap fails or cannot be completed, or when you decline verification (except as described in section 8).
- Refunds go to the refund address you gave or, if you gave none, to the address the coins came from. They cannot be sent to any other address. If you sent from an exchange account, a refund to the sending address may not reach you, so give a refund address.
- Network fees are taken from the refunded amount.
- Coins that cannot be returned straight away may be kept for up to one year. After that we will still try to return them, but we cannot guarantee it.
- We do not pay for price changes while a swap is on hold or being refunded.
10. Stolen coins
If coins in a swap are reported as stolen, they may be frozen. They are returned only after an official request from the police or another competent authority, to the address they came from or to the refund address.
11. Availability and changes to the service
We aim to keep HiddenSwap running at all times, but we do not promise that it always will be. We may pause the service for maintenance, and change supported coins, limits and features at any time. We may refuse, pause or stop any swap, or block any user, including when our partner, the law or a risk check requires it.
12. No advice and no warranties
HiddenSwap is provided “as is” and “as available”, without warranties of any kind. We do not give investment, legal or tax advice. Crypto prices are volatile, and you can lose money. Read the risks in Risk and screening.
13. Limitation of liability
As far as the law allows:
- we are not liable for indirect or consequential losses, including lost profits,
- we are not liable for losses caused by wrong addresses, networks, memos or amounts, by blockchain or network problems, by third parties, or by events outside our control,
- our total liability for any claim about a swap is limited to the lower of the value of that swap and EUR 500.
Nothing in these terms limits liability that the law does not allow us to limit.
14. Prohibited use
You must not:
- use HiddenSwap for money laundering, terrorist financing, fraud, sanctions evasion, illegal gambling or any other illegal activity,
- send coins that are stolen or come from crime,
- disrupt, overload or reverse engineer the website, or access it with bots or scrapers,
- upload malware,
- pretend to be someone else or give false information.
15. Your responsibility to us
If you break these terms or the law and someone makes a claim against us because of it, you will cover our reasonable losses and costs.
16. Intellectual property and links
The HiddenSwap name, logo, design and content belong to us. Links to other websites are for convenience; we are not responsible for those websites.
17. Disputes
If something goes wrong, contact us first with your order ID so we can try to solve the problem together. Nothing in these terms takes away rights that the law of your country gives you.
18. Changes to these terms
We may change these terms. The date at the top shows the latest version. The terms in force when you start a swap apply to that swap.
